On Retroactive Application of the Law Determining the Liability for International Crimes
This Constitutional Law is adopted with a view to bringing application of the existing criminal legislation norms, which provide for liability for criminal acts against peace and humanity, acts of genocide and war in the Republic of Azerbaijan in line with the relevant provisions of the Convention on Protection of Human Rights and Fundamental Freedoms and the International Covenant on Civil and Political Rights.
Article 1.
In line with the generally adopted international legal norms, no provision of the Constitution of the Republic of Azerbaijan may be interpreted or understood as a provision that impede bringing any individual to trial or punishing due to an act (action or inaction) considered as crime when committed.
Article 2.
Criminal prosecution of individuals who committed the acts (action or inaction) stipulated in Article 1 of the present Constitutional Law may be implemented only when the liability for the same crime was determined in the Criminal Code of the Republic of Azerbaijan.
